Will I be able to claim my children as dependents?

In my divorce settlement it states that my ex can claim our children on our taxes as dependents. The children live with him for 9 months and with me for 3 months out of the year. If our custody schedule was changed would there be a likelihood that I could also claim them as dependents?

It would be likely that the tax deduction would switch if you had primary custody. But it can remain the same by agreement.
